Welcome to Daggnabit.com! Please carefully read these Terms of Service before using our website. By accessing or using our website, all website visitors agree to be bound by these Terms of Service. If you do not agree, you may not use our website.

Introduction:
Daggnabit.com LLC ("Daggnabit LLC", "Daggnabit," "Daggnabit.com" "we," "us," or "our") offers a prank mail service that allows our customers ("customer", "you," or "your") to send anonymous prank mail, on behalf of themselves, to their prank recipient's ("recipient", or "prank recipient,") address. Our service is intended for fun and light-hearted practical jokes amongst friends. Our service includes the option to personalize and customize the customer's prank package. Pranks, products, add-ons, customizations, personalizations, and services can be created and removed by us at any time. This Terms of Service is a binding agreement between Daaggnabit.com, the customer, and the recipient.

Harassment Policy:
Our service is STRICTLY for light-hearted practical jokes amongst friends. Our service is not for revenge, spite, to be mean, or harassment of any sort. Customers agree to not use our service to send prank mail to people they do not like or do not know. Customers agree to only use our service to send prank mail to people they are personal friends with. Harassment is taken very seriously. It is your responsibility as the customer to choose a prank that your recipient will find appropriate and funny. Using our service for anything other than light-hearted practical jokes amongst friends, as solely determined by us, violates our Terms of Service and/or Harassment Policy.

If we deem that you have violated our Harassment Policy and/or Terms of Service, your identity is at risk of being revealed to the recipient of your prank package, and you are at risk of being banned from using our website and services. We alone have the right to decide what does and does not violate our Harassment Policy and/or Terms of Service. We alone have the right to decide if a violation of our Harassment Policy and/or Terms of Service will result in the customer's identity being revealed.

We reserve the right to cancel and refund any order for any reason - especially the violation or potential violation of this Harassment Policy. If we find a customer's personalized note in their order to possibly be harassing towards their prank recipient, we reserve the right to edit the customer's personalized note or remove it from the from your order without notifying the customer or recipient. 

If you do not wish to receive future prank mail from us, please email us at daggnabit25@gmail.com and we will add you to our Address Blacklist. We do not mail prank packages to any address on our Address Blacklist.

We reserve the right to choose to respond or not respond to any means of communication from anyone regarding any subject.  Do not expect any further replies from customer support if you threaten us legally or in any other way via any means of communication. Threats will be determined solely by us. Any impolite form of communication will not be responded to at our discretion. We proudly respect our employee's rights to a peaceful work environment.

Customer Support:
Customer support is available via the form on our customer support page. We usually reply within one business day. We always check our messages before shipping new orders so that any message regarding a change or cancellation to a new order is addressed before the order is shipped. We cannot change or cancel an order after shipment.

We reserve the right to choose to respond or not respond to any means of communication from anyone regarding any subject. Do not expect any further replies from customer support if you threaten us legally in any way via any means of communication. Use of Our Service:
Our service is STRICTLY for light-hearted practical jokes amongst friends. To use our service, you must be at least 18 years old and your prank recipient must also be at least 18 years. See the above Harassment Policy for more details.

Information Collection & Marketing:
We will never sell or share our customer's personal information with other any business or marketing agency, except as outlined in this Privacy Policy. We use cookies and other tracking technologies to collect basic information from our customers, including (but not limited to) names, addresses, phone numbers, email addresses, order information, user movements on our website, and payment information. All payment information is secured by Shopify's checkout system. We never store or see credit card numbers or other compromising payment information. Other information such as names, addresses, emails, phone numbers, and order information is stored on secured web apps and computers. The web apps are secured with two-factor authentication and passwords. The computers are password-protected and held on a private network. Collected information may be used for customer outreach and to market our products and services. Customers can opt out of marketing emails and text messages at any time. Reply 'STOP' to opt out of SMS messages. Click 'Unsubscribe' at the bottom of our emails to stop receiving our emails. Customer information may be shared with third-party service providers that we hire to do certain tasks for us, such as automation platforms, Shopify Apps that perform tasks on our website, Affiliates who may have referred a customer to our website, data analysis platforms, ect. None of our third-party service providers are permitted to share or use your personal information for any reason other than what they have been hired to do. Third-party service providers have access to personal information only as long as it is necessary for them to perform their functions, and they must process it in line with this Privacy Policy. Shipping:

Tracking is included on all shipments. Orders are usually shipped within one business day of your purchase. Shipping is anonymous. We use a fake return address to secure your anonymity. Customers can choose to reveal their identity in a personalized note if they choose to. It's free to add a digitally-delivered personalized note to any prank package. You will receive an email with tracking information after your order ships. We only ship to US addresses. Please note that our refund policy does not cover typos in the shipping address or cancellation of orders after the item has been shipped. 

Gift cards are delivered digitally.

Liability:
By using our website and services, customers agree to assume all risks and liabilities associated with the use of our pranks and services. Customers and prank recipients completely indemnify and hold Daggnabit.com harmless against claims arising from the use or misuse of our service. Daggnabit.com will not be held liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use our website or services. Our customers, website visitors, and prank recipients agree to indemnify and hold us harmless against all claims, demands, damages, and expenses arising from any use or misuse of our website or services. Daggnabit.com will not be held responsible for any prank that may result in bodily harm, property damage, emotional distress, workplace issues, legal action or any other consequence of using our service. Our maximum liability to any customer or prank recipient shall be limited to the total amount paid by the customer for their purchase.

Dispute Resolution:
If you are unhappy with your purchase for any reason, please contact us immediately. We handle every customer with care on a case-by-case basis and are committed to ensuring your complete satisfaction with our service. We treat all our customers fairly, please do not hesitate to get in touch.

Customers and prank recipients agree to handle all disputes between yourself and Daggnabit.com via arbitration rather than any court or legal action. You agree to never pursue legal action against Daggnabit.com. You agree that the arbitration costs shall be your responsibility. The arbitrator shall be an independent person appointed to settle the dispute agreed upon by you and us together. We have the right do deny a dispute or arbitration if we do not feel that the situation requires it.

Modification and Termination Rights:
We reserve the right to modify, amend, or update these Terms of Service at any time, without prior notice or liability to our customers. Your continued use of the Daggnabit.com website and/or services constitutes your acceptance of any such changes. We encourage you to review these Terms of Service regularly to stay informed of any updates or modifications.

We reserve the right to ban any customer from using our services and website for any reason. This may include the termination of communication with the banned customer. Any banned customer will not have their future orders shipped. We do not have to notify a customer that they have been banned. If we do notify a customer that they have been banned, we retain the right to treat all their future order(s) as donations without shipping or refunding the order(s). We will notify the banned customer that their future orders will not be shipped or refunded before we treat their future order(s) as donation(s) - i.e. not shipping or refunding them. This is used as a deterrent to prevent bad customers from attempting to misuse our service.

We reserve the right to ban prank recipients. This may include the termination of communication with the banned prank recipient. Banned recipients will have their addresses blacklisted - meaning that our customers will not be allowed to ship to their addresses anymore. We do not have to notify a prank recipient that they have been banned.

Governing Law and Jurisdiction:
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without giving effect to any principles of conflicts of law. Any dispute arising out of or in connection with these Terms of Service, including any question regarding their existence, validity, or termination, shall be resolved within the parameters of the Dispute Resolution section above. Any further dispute leading to legal action shall be resolved within the state and federal courts located in Delaware County, Pennsylvania.
